Xscorts respects the intellectual property rights of all creators and copyright owners. We take allegations of copyright infringement seriously and will act promptly to investigate and respond to any valid notices received.

Although Xscorts is an Australian-based service, we recognise the enforcement mechanisms provided under the United States Digital Millennium Copyright Act (DMCA) and provide a formal process for copyright holders to request removal of infringing material.

If you believe your copyrighted material is being used on xscorts.com.au without authorisation, you may submit a written notice of claimed infringement.

1. Information Required in a Valid DMCA Notice

To process your request, you must provide all of the following:

1. A physical or electronic signature
   of the copyright owner or authorised representative.
2. Identification of the copyrighted work(s)
   you believe have been infringed.
   If multiple works are involved, you may provide a list.
3. Identification of the infringing material
   including sufficient detail for Xscorts to locate the material (e.g. profile link, image URL, listing ID).
4. Your contact information, including:
   • full name
   • postal address
   • telephone number
   • email address
5. A good-faith statement, declaring that:
   “I have a good-faith belief that the use of the copyrighted material described above is not authorised by the copyright owner, its agent, or the law.”
6. A statement of accuracy and authority, made under penalty of perjury, declaring that:
   “The information in this notice is accurate, and I am the copyright owner or am authorised to act on behalf of the copyright owner.”

Incomplete notices may delay or prevent processing.

2. How to Submit a DMCA Complaint

3. What Xscorts Will Do Upon Receiving a Valid Notice

Once a valid DMCA notice is received:

• The material identified will be reviewed.
• Xscorts may temporarily disable, remove, or restrict access to the material.
• Xscorts may notify the Advertiser or user who posted the content, providing them with an opportunity to submit a counter-notification where appropriate.
• Repeat infringers may have their accounts suspended or permanently terminated.

Xscorts may request additional information when necessary to verify the claim.

4. Counter-Notification Procedure

If material is removed due to a DMCA notice and you believe the removal was in error, you may submit a counter-notification including:

• your contact details,
• identification of the material removed,
• a statement made under penalty of perjury that the material was removed by mistake or misidentification,
• consent to jurisdiction of the relevant courts.

If a valid counter-notification is received, Xscorts may restore the material unless the original complainant initiates legal proceedings within the required timeframe.

5. Abuse and Fraudulent Claims

Xscorts fully cooperates with copyright owners to protect their intellectual property.
However, due to the increasing misuse of DMCA processes, Xscorts reserves the right to:

• pursue legal claims against individuals who knowingly file fraudulent or abusive DMCA complaints,
• seek reimbursement for damages, administrative costs, and losses incurred because of false claims.

Knowingly submitting false DMCA notices or counter-notices may result in civil or criminal liability.
